Terms of Service

Last updated: September 2026. These terms govern purchases from FocalCut, a brand of Big Bay Mall LLC, a Wyoming-registered company ("FocalCut", "we").

1. Services & Packages

FocalCut sells one-time video editing packages (Starter: 4 videos; Consistency Builder: 10 videos; Growth Engine: 15 videos). Each package grants a fixed number of video credits. Packages are not subscriptions and do not renew automatically.

2. Deliverables

A deliverable is one edited short-form video (15–30 seconds) produced from client-supplied footage, delivered as a platform-ready MP4 (9:16). Videos outside these specifications may be quoted separately.

3. Turnaround

Turnaround begins only when we receive complete footage, written instructions and any references. First-draft delivery: 24 hours (Growth Engine) or 48 hours (other packages). Delays caused by incomplete client materials pause the turnaround clock.

4. Revisions

A revision is a change to an existing edit based on the original brief. Included rounds: Starter 0, Consistency Builder 1, Growth Engine 2 per video. New concepts, new footage or substantially different creative direction constitute a new edit and consume an additional credit.

5. Client Responsibilities

You warrant that you hold all necessary rights to source footage, images, logos and any music you supply. FocalCut is not liable for copyright claims arising from client-supplied assets.

6. Music & Licensing

Where we select music, we use commercially reasonable, platform-library or royalty-free sources. FocalCut does not grant synchronization licenses for third-party commercial tracks.

7. Ownership

Upon full payment, you own the final delivered edits. FocalCut may request permission to feature completed work in its portfolio; you may decline or withdraw permission at any time.

8. Unused Credits

Unused credits remain available to you. We recommend use within 45 days for content momentum but do not expire credits unilaterally without 30 days' notice.

9. Acceptable Use

We may refuse projects that promote illegal activity, hate, harassment or deceptive claims.

10. Liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid for the affected package. We do not guarantee platform performance, reach or view counts.

11. Governing Law

These terms are governed by the laws of the State of Wyoming, USA.
